General Data Protection Regulation (GDPR) Privacy Notice

The following is my GDPR Notice in connection with the services I provide.

As your driving school instructor, I collect and store your personal information. This notice explains why I need this data, how it will be used, who it may be shared with, and how long it will be retained. Additionally, it outlines your rights under the General Data Protection Regulations (GDPR).

1. Records for accounting purposes

  • I maintain written and secure digital records of payments, lesson appointments, and delivered lessons. These records are necessary for accurate accounting, as legally required, and are retained for six years. After this period, the records and associated personal information are securely disposed of.

  • These records are stored in my paper-based/digital diary, Student Record System, and accounts sales day book.


2. Personal information required

  • To provide my services as a driving school instructor, I collect the following details:

    Name and address
    Telephone number(s)
    Date of birth
    Provisional driving licence information

  • This information is used for legitimate communication and is recorded in my paper-based Student Record System.

  • Additionally, it supports accurate accounting, as mentioned in point 1.


3. Learning Progress Records

  • I maintain records of your learning progress in my Student Record System. These help you track your training program's status.


4. Test performance records

  • I record test failures and passes, noting driving faults on your test report. This allows me to monitor my own performance.


5. Consent for promotion

  • Upon passing the driving test, I seek your consent to take a photograph and a written review.

  • These may be used to promote my services on secure digital platforms and written media, with your permission.

  • Note that on social media, I cannot prevent others from sharing or copying this content.


6. COVID-19 contact tracing

  • If necessary, I may share your contact details with the NHS Test and Trace Service to identify potential COVID-19 exposure.


7. Dash cam usage

Purpose of Dash Cams

  • If I use a dash cam in my training vehicle, it serves two main purposes: a) To aid your learning during driving lessons. b) To support insurance claims in case of incidents.

  • For any other purpose, I will seek your written consent beforehand.


Signage and camera placement

  • If cameras are installed, clear signage will be visible both externally and internally in the training vehicle.

  • Outward-facing cameras record the surroundings outside the vehicle, while inward-facing cameras primarily capture the front two seats.


Customer awareness

  • I inform all customers about the presence of dash cams.

  • New customers receive this information before their first driving lesson.


Your rights

  • If you're uncomfortable with being recorded, you have the right to request that interior-facing cameras be turned off during your lesson.

  • Audio recording only occurs if it aids your learning; otherwise, the camera remains muted.


Retention and deletion

  • Once you are no longer my customer, I delete video footage of your lessons within 30 days unless you grant written permission for extended use.

  • I may retain footage as required by my insurance company for actual insurance claims.


8. Data retention period

  • Personal information not disposed of as stated above will be securely destroyed after 6 years from receipt, unless you consent to longer retention.


9. Complaints

  • If you have concerns about how I've processed your personal information, you can contact the Information Commissioner’s Office (ICO) at www.ico.org.uk/concerns.

Proof of Entitlement to Drive

In June 2015, the paper counterpart of the driving licence was abolished and driving licences now consist of just the photo card.

Endorsements, penalty points and driving bans will no longer be recorded on driving licences, but will instead only be accessible online.

For insurance purposes, before your first driving lesson your Instructor is required to check your full licence details to see the vehicles you’re allowed to drive, and to check for penalty points and disqualifications.

The consequences for not checking the above are very serious and this procedure is in place to protect you, your instructor and the general public.

You must follow these simple steps before the first lesson.

You’ll need to generate a code which will allow your instructor to check your licence details:

You will need:

  • Your driving licence

  • Your national insurance number

  • Your home postcode

Step one:
Enter your driving licence number, national insurance number and postcode as shown on your driving licence.

Step two:
Click on “share licence information”. This creates a code. The code is case sensitive, can only be used once, and is only valid for 21 days.

Step three:
Pass the code to your Instructor together with the last eight digits of your driving licence number.

In advance of your first driving lesson your Instructor will view your licence details on line. Be aware that your Instructor may save a screenshot as evidence of the licence entitlement check.

Please note you should also produce your photo card licence for ID inspection on your first lesson. It is your responsibility to provide your Instructor with proof that you have a valid licence to drive, before the commencement of your first lesson. If you fail to provide this proof, your Instructor is entitled to refuse to conduct the lesson but still charge you.

Terms and Conditions (Customer Care Charter)

The following terms and conditions outline the basis on which the instructor and driving school owner (I/me/mine) provide driving lessons and courses to the student (you/your).

1. General conduct

  • I will always be courteous, punctual, and maintain a professional and ethical demeanour.

  • I will not use your lesson time for any other business without your permission.

  • Smoking is prohibited in the training car.


2. Qualifications

  • I am legally authorized by the Driver and Vehicle Standards Agency (DVSA) to offer driving tuition in the UK.


3. Driving license and eyesight

  • You must hold a valid driving license (provisional or full) and provide it before our first lesson.

  • You must prove your entitlement to drive and share a license check code with me.

  • You must ensure you can read a number plate from 20.5 meters (about 67 feet) using visual aids if needed.


4. Your safety, comfort and well-being

  • The training car is equipped with dual controls, and is fully insured for driving tuition.

  • I will keep the training car clean and well-maintained.

  • You must wear suitable footwear and clothing for comfort and safety.

  • You must stay focused during lessons and communicate any distractions or discomfort. If your concentration is impaired, we may adjust the lesson for safety.

  • You must follow my instructions in emergencies, allowing me to take control if necessary.

  • You must inform me of any medication or factors that may affect your ability to drive safely.

  • I will deliver instructions calmly and respectfully, avoiding any negative remarks.

  • I will not use use any improper language, suggestive behaviour or physical contact.


5. Driving under the influence (DUI)

  • For safety reasons, I reserve the right to cancel any lesson if you are, or if I suspect you are, under the influence of drugs, legal highs, or alcohol (prescribed or otherwise). In such cases, the full training fee for the affected period will be lost or charged.


6. Lesson postponement

  • If you postpone or cancel lessons booked in my diary, you may incur costs, especially if I cannot find replacement work for those appointment times.

  • I also reserve the right to postpone lessons due to unsuitable or dangerous weather or road conditions. Unfortunately, I cannot be held responsible for any resulting costs.


7. Punctuality

  • You need to be punctual for your lesson appointments. I would suggest you make a note of all upcoming appointments in your diary to avoid mistakes.

  • If you are late, I will wait a maximum of 15 minutes before considering the lesson abandoned and charging the fee. Reciprocal waiting may apply if I am delayed due to unforeseen circumstances.


8. Payments

  • You are required to make payment three working days in advance for driving lessons.

  • Once the booking has been accepted by me and placed in my diary, a binding agreement is made between yourself and me. The training fees are non-refundable in the event that you decide to cancel the training less than 48 hours before the lesson. This does not affect your statutory rights.


9. Driving test appointments

  • Test bookings take priority over lessons. If there are lesson changes due to test appointments for other students, I will promptly inform you of this.

  • You must notify me of your test appointment as soon as possible to ensure the availability of the training vehicle.

  • I reserve the right to withhold the use of the training vehicle if, in the interests of safety, I deem your driving to be actually or potentially dangerous.


10. Lesson prices and special offers

  • I reserve the right to make changes to prices for lessons without notice.

  • I may introduce or modify special offers from time to time.


11. Complaints

  • If you have a complaint, you are to address this to me and allow me an initial opportunity to resolve it.


12. Your statutory rights

  • These terms do not affect your statutory rights regarding faulty goods or services. I am obligated to provide goods and services fit for their intended purpose.
